At any rate, the Department values your vigilance and continued engagement on
matters affecting local governance. Nonetheless, in light of the clarity of the law,
prevailing jurisprudence, and the Department's long-standing and consistent
interpretation thereof, the Department respectfully maintains that its position has been
sufficiently articulated and remains legally sound. Should Congress see fit to
recalibrate the scope of concurrence through legislative amendment, the Department
will, as always, faithfully implement the law as written. Until then, the Department
remains bound to apply the Code and jurisprudence as they presently stand.
The foregoing opinion is rendered solely on the basis of the facts presented and our
appreciation of the same.
We hope to have addressed your concern accordingly.
Respectfully yours,
BY AUTHORITY OF THE SECRETARY:
Piha
